CUAET Program for Ukrainians

The Canada-Ukraine Authorization for Emergency Travel (CUAET) was established to assist Ukrainians impacted by the Russian invasion, offering them the chance to apply for entry to Canada until July 15th, 2023. The Government of Canada has extended the deadline for overseas travel until March 31, 2024, for current CUAET holders. CUAET permits Ukrainians and their families to relocate to Canada under temporary resident visas, enabling them to work and study for a duration of three years.

Immigration programs:

New PR Pathway for Ukrainians with Family in Canada

Effective October 23rd, 2023, Canada introduced a new pathway aimed at providing Permanent Residence for Ukrainian nationals who have family members* residing in Canada. This initiative offers Ukrainian citizens with temporary resident status in Canada the opportunity to obtain Permanent Residence if they have one or more family members who are Canadian citizens or Permanent Residents.

 

There are two categories under this pathway:

  1. Family Members of Canadian Citizens or Permanent Residents in Canada.

  2. Spouses or Common-law Partners of Ukrainian Nationals with Family in Canada.

Family members eligible for sponsorship include the spouse or common-law partner, child (regardless of age), grandchild, parent, grandparent, or sibling (or half-sibling) of a Canadian citizen or permanent resident *

Humanitarian and Compassionate Considerations

If you're a Ukrainian national facing exceptional circumstances and seeking to apply for permanent residence in Canada, you may be eligible under the Humanitarian and Compassionate (H&C) Consideration program.

Under this program, certain foreign nationals who would not otherwise qualify for permanent residence may be granted consideration based on compelling H&C grounds. Factors such as your establishment in Canada, family ties, potential consequences if your request is not granted, conditions in your country of origin, and health considerations are taken into account during the evaluation process.

The decision-making process for H&C applications is discretionary, meaning officers have flexibility in their decision-making. It's essential to provide clear and compelling evidence demonstrating the hardships you would face if exemptions are not granted.

Express Entry Immigration Program

The Express Entry program is an immigration pathway designed to facilitate the entry of skilled workers into Canada. This program is open to Ukrainian nationals who possess the necessary skills, education, and work experience to contribute to Canada's economy. Under Express Entry, Federal Skilled Workers across 370 eligible occupations who meet minimum entry criteria, submit an expression of interest profile to the Express Entry Pool.

Key features of the Express Entry program include:

  1. Three main immigration streams: Federal Skilled Worker Program, Federal Skilled Trades Program, and Canadian Experience Class.

  2. Eligibility criteria based on factors such as age, education, work experience, language proficiency, and adaptability.

  3. Comprehensive Ranking System (CRS) score used to rank candidates in the Express Entry pool.

  4. Regular draws conducted by the Canadian government to invite candidates with the highest CRS scores to apply for permanent residence.

  5. Fast processing times, with most applications processed within six months.

Provincial Nominee Programs (PNPs)

Provincial Nominee Programs (PNPs) offer Ukrainians a pathway to Canadian permanent residency through nomination by a specific province or territory. Each province and territory in Canada operates its own PNP, tailored to address the unique labor market needs and economic priorities of the region.

Key Features of PNPs:

  1. Provincial Specific Criteria: Each PNP has its own set of eligibility criteria and streams targeting different categories of skilled workers, international graduates, entrepreneurs, and others.

  2. Selection Process: Applicants must demonstrate their intention and ability to settle in the specific province or territory and meet the criteria outlined by the respective PNP.

  3. Express Entry-linked Streams: Some PNPs have streams aligned with the federal Express Entry system, allowing candidates to receive additional points toward their Comprehensive Ranking System (CRS) score and increase their chances of receiving an Invitation to Apply (ITA) for permanent residency.

  4. In-demand Occupations: Many PNPs prioritize occupations that are in high demand within their respective provinces, offering expedited pathways to permanent residency for individuals with skills and experience in these fields.

  5. Community Endorsements: Certain PNPs may require applicants to obtain endorsements or support from designated communities or employers within the province or territory.

Ontario Immigrant Nominee Program (OINP)

The Ontario Immigrant Nominee Program (OINP) is an immigration program operated by the province of Ontario, Canada. It allows Ontario to nominate individuals for permanent residency who have the skills and experience needed in the province's labor market. Here's some detailed information about the program:

 

Key Features of The Ontario Immigrant Nominee Program:

  1. Streams and Categories: OINP offers various streams and categories tailored to different types of applicants, including:

   - Employer Job Offer Category: For skilled workers with a job offer from an Ontario employer.

   - Human Capital Category: For individuals with education, work experience, language proficiency, and other factors that contribute to Ontario's economy.

   - Business Category: For entrepreneurs looking to start or purchase a business in Ontario.

 2. Nomination Process: Applicants must meet the eligibility criteria for their chosen stream and category. If nominated by Ontario, they can then apply for permanent residency to Immigration, Refugees and Citizenship Canada (IRCC).

 3. Occupation In-Demand: OINP often targets specific occupations in high demand in Ontario's labor market. These occupations may change based on the province's economic needs.

 4. Minimum Requirements: Each stream and category has its own set of minimum requirements, such as education, work experience, language proficiency (English or French), and settlement funds.

 5. Processing Times: Processing times for OINP applications vary depending on the stream and category. Generally, they can range from several months to over a year.

 6. Additional Considerations: Applicants may need to provide additional documentation, attend interviews, or meet other requirements as part of the application process.

 7. Updates and Changes: The program's eligibility criteria, streams, and categories may change over time in response to Ontario's economic priorities and immigration goals.

Family Sponsorship

Family Sponsorship is a program that allows Canadian citizens and permanent residents to sponsor their eligible family members from Ukraine to immigrate to Canada and obtain permanent residency.

Key Features of Family Sponsorship:

  1. Eligible Relatives: Sponsored family members can include spouses, common-law partners, dependent children, parents, and grandparents.

  2. Sponsorship Obligations: Sponsors must meet financial support requirements and ensure sponsored family members do not require government assistance.

  3. Processing Times: Times vary based on the relationship and the country of application.

  4. Permanent Residency: Successful applicants receive permanent residency, allowing them to live, work, and study in Canada indefinitely.

  5. Family Reunification: The program enables families to reunite in Canada.

The Caregiver Program

The Caregiver Program is a Canadian immigration pathway designed to address the growing demand for caregivers in Canada by allowing foreign workers to immigrate and work as caregivers for children, elderly individuals, or individuals with medical needs. Start-up Visa Program
